Jervis Pendleton was born on March 3, 1816, in Lancaster County, Virginia. His father was a lawyer and his mother a teacher. In 1832, Pendleton was admitted to the bar in the state of Virginia. He began his law practice in Richmond, Virginia, in 1835 where he remained for the next several years. In 1838, Pendleton moved to Houston, Texas, where he set up a law practice. He became a local politician and a member of several civic organizations in Houston. In 1846, Pendleton was a delegate to the Texas secession convention from Harris County. In the capital city of Austin, Texas, he was elected to the Constitutional Convention of 1845-1846, which drafted the constitution for the Republic of Texas. In 1845, Pendleton was nominated for a seat in Congress from Texas. However, he declined the nomination because he thought that Texas would be annexed to the United States and that there would be no need for a representative from Texas in Congress after annexation. He was also skeptical about creating a state government in Texas and felt that Congress would continue to oversee Texas until annexation and statehood.
