In the year 2000, the FBI asked for permission from a judge to force McKinnon to cooperate by making it easier for them to bug his room. The judge declared that the FBI could not force McKinnon to do anything that would violate his civil rights, and that he had a right to be free from unreasonable search and seizure.
According to the judge, the FBI needed to show that they had probable cause to conduct a search. That’s a fairly high standard for a search warrant, and it wouldn’t apply to a hacker. So the FBI got a warrant from a different judge, but that judge rejected the same request. The court ruled that the FBI lacked probable cause to bug McKinnon’s room, and that the FBI didn’t have a right to search his room.
In 2003, NBC reported that the FBI was still intent on getting access to McKinnon’s computer, but was unwilling to make it easy for him, so they wanted it to be harder for him to get the information off of it.
